The relationship between Goweekender ( the Aggregator) and its Users (Travellers) is governed by a User Agreement , which defines the Platform as an intermediary connecting Travellers with "Hosts" and Travel Organisers. GOWEEKENDER'S MOBILE APPLICATION is purported to be the Platform in this Agreement. Users, including a Traveller and a group of Travellers, shall be individually referred to as a party to this Agreement. This User Agreement sets forth the terms and conditions for the use of the services and products provided by Goweekender Private Limited ("GOWEEKENDER") , which are covered by these Terms of Service (collectively , the " User Agreement"). Any person ("User") who enquires or makes a purchase regarding any of GOWEEKENDER 's products or services through its website , mobile application , sales representatives , offices , call centers , branch offices , franchisees , agents, etc. , agrees to be bound by this User Agreement. The "Terms of Service" available on the GOWEEKENDER website provides a detailed description of the terms and conditions applicable to various GOWEEKENDER services and products . The User should understand the terms of service applicable to the product or service booked by him/her. These Terms of Service will be effective upon them. Before using this website , contacting any sales channel or availing any of GOWEEKENDER 's services , the User must read and understand this User Agreement. The User will be deemed to have accepted that their dealings and transactions with GOWEEKENDER are subject to the User Agreement. If any part of this Agreement is not acceptable to the User , the User should not avail of the services of GOWEEKENDER and should not use this website or contact any sales channel. All rights and obligations of the User and GOWEEKENDER relating to GOWEEKENDER products and services shall be limited by this User Agreement . This Agreement shall be deemed to apply to the User upon acceptance by the User on the Goweekender mobile app.

Users must be at least 18 years old and legally capable of entering into contracts to use GOWEEKENDER 's services as a User. Minors under the age of 18 are not permitted to register as Users on the Website , conduct transactions on the Website , or use the Website. We reserve the right to terminate your membership and/or restrict your use of the Website if it becomes clear that you are a minor , legally incapable of entering into a contract , or have provided false age information when creating an account .

GoWeekender acts as an information aggregator rather than a direct service provider. GoWeekender will always act as a facilitator through which users connect with service providers. GOWEEKENDER's liability shall be limited to providing the User with the booking selected and confirmed by him.

• •Intermediary status: The agreement typically specifies that Goweekender does not own or manage the actual travel inventory (accommodations , tours , or transportation) Any problem that may arise while the user is using such service will be the sole responsibility of the service provider. GOWEEKENDER SHALL HAVE NO LIABILITY FOR NEGLIGENCE of any Service Provider's acts, omissions, errors, representations, warranties, breaches.
• •Limitation of Liability: The Platform disclaims responsibility for any shortages, injuries or damages that may occur during travel organized by third-party hosts.
• •Accuracy of Content: Users acknowledge that travel details (itineraries , prices , and availability) are provided by the Host and are subject to change.
• •Unless otherwise expressly committed by GOWEEKENDER with respect to a product or service, GOWEEKENDER is not liable for the level of service provided by any Service Provider. GOWEEKENDER does not guarantee their demonstrated quality or suitability, however, offers the best choice of Service Providers based on their quality of experience.
• •GOWEEKENDER does not guarantee the availability of any Service Provider's services. The User agrees that for any booking made through GOWEEKENDER , the Service Provider may refuse to provide the services to the User , without assigning any reason or for reasons such as practicality , public safety , health hazards , infectious diseases , government orders/notifications etc. or for any other reason. In such a situation of refusal, the liability , whatsoever , shall be entirely of the ultimate service provider , as it is outside the scope of GOWEEKENDER.
• •The User agrees that any claim, refund or damages for such refusal shall be solely on the end service provider and not on GOWEEKENDER .

GoWeekender's website and mobile application collectively provide a secure interface for instant payments through GoWeekender UPI, cards and wallets.

• •Contract Formation: Once a booking is confirmed through the Platform, a binding contract is formed between the User and the Host. GOWEEKENDER will not provide any services or share booking details until full payment has been received from the User.
• •Verified Profiles: To enhance trust , the platform uses verified profiles and secure transactions.
• •In addition to the booking cost of the Service Provider , GOWEEKENDER reserves the right to levy certain charges as convenience fee or service fee. GOWEEKENDER also reserves the right to change any or all of the Fees from time to time. All such additional charges , including amendment charges , will be displayed to the User before the booking is confirmed or paid for.
• •If due to any technical error or otherwise, the booking amount , taxes , statutory charges , convenience fee etc. are short charged, GOWEEKENDER shall have the right to deduct , charge or claim the balance amount from the User , and the User shall pay such balance amount to GOWEEKENDER . If a reduction in the fee is claimed before the booking is used , and the amount is not paid before the date of use , GOWEEKENDER may cancel such booking .
• •Any increase in the price determined by GOWEEKENDER due to change in the rate of tax or imposition of new tax by the government shall be borne by the User. These taxes and levies may be without prior notice and may also be retrospective , but will always be in accordance with applicable law.
• •In the rare event that the booking is not confirmed for any reason , GOWEEKENDER will refund the booking amount paid by the User and inform the User of the same. GOWEEKENDER will not be responsible for providing alternative bookings or compensating for unconfirmed bookings. Every booking thereafter will be treated as a fresh process. Returns will be processed in accordance with the policies of the service provider and GOWEEKENDER .
• •All fees, charges, surcharges, duties, taxes and assessments applicable as per laws on the use of the Service shall be the sole responsibility of the User.
• •The User agrees and understands that all payments shall be made into the bank accounts of GOWEEKENDER only GOWEEKENDER or its representatives , agents or employees will never instruct a customer to transfer funds to a personal account or an account registered in a non- GOWEEKENDER name . The User agrees that GOWEEKENDER shall not be held liable if he deposits any amount for any booking or transaction into a bank account which is not duly registered with GOWEEKENDER or is a personal account of any person. The User shall have no right to obtain a refund from GOWEEKENDER of any amount paid by him to any third party .
• •The User shall not share his/her personal sensitive information such as Credit/Debit Card Number , CVV , OTP , Card Expiry Date , User ID , Password etc. with anyone including GOWEEKENDER 's agents , employees or representatives. If such information is requested by any agent, employee or representative, the User must immediately notify GOWEEKENDER. GOWEEKENDER will not be liable for any loss caused to the user by sharing such details of his/hers.

• •Accurate information: Users must provide correct passenger details (names matching ID/ passport) and will be responsible for any charges incurred due to errors. Users are advised to check the product and service details carefully before making a booking . The User agrees to accept all the terms and conditions as stated in the Booking Confirmation or Booking Voucher. These Terms should also be interpreted by the User as a contract .
• •Conduct: Users are often required to comply with health and safety regulations (such as local state tourism laws like the Goa Tourism Promotion Act) and maintain respectful behavior towards hosts.
• •The User undertakes to comply with all procedures and guidelines relating to the use of the services available through GOWEEKENDER , as may be amended from time to time . The User further undertakes to comply with all applicable laws , regulations , orders , instructions etc. issued by the Central Government , State Government , District Administration or any other statutory body relating to the use of the Services or every transaction .
• •User agrees to abide by GOWEEKENDER 's User Agreement and Terms of Service, as well as the Activity Provider's terms and conditions.
• •To avail the activity , the user must present the booking/confirmation voucher issued by GOWEEKENDER .
• •The user must possess valid documents , such as identity card , proof of address , passport for the activity booked outside India , or any other document specified by the activity provider.

• •Unless GOWEEKENDER expressly provides insurance in a service or product , it is the user's responsibility to obtain adequate insurance coverage. Under no circumstances will GOWEEKENDER accept any such claims.
• •If GOWEEKENDER provides insurance as part of a service or product , it will be subject to the terms and conditions of the third-party insurance company. GOWEEKENDER only acts as a facilitator connecting the user with the insurance company. For any claims or disputes, the user must contact the insurance company directly. GOWEEKENDER will not be held liable for partial acceptance or rejection of claims.
• •GOWEEKENDER does not control such websites and is not responsible for their content. If a user accesses a third-party website , it is at the user's sole discretion and GOWEEKENDER assumes no liability for the same .
• •GOWEEKENDER does not endorse any advertiser on its website, or any linked site, in any way. Users are requested to verify the accuracy of all information provided on third party web pages.

While specific policies may vary by trip , refunds are subject to the service provider's policies.

• •Host-specific policies: Refunds are typically subject to a specific cancellation window set by the individual host or vendor.
• •Technical failures: If a transaction fails or a service cannot be provided due to an aggregator-side technical glitch , a full refund is usually issued.
• •Any refunds for canceled bookings will always be processed to the relevant account or banking method (credit card , wallet, etc.) used to pay for the booking .
• •Processing Timeline: Approved refunds typically take 7 to 21 days to reflect in the User's account depending on bank processes .
• •The cancellation policy applicable to bookings made by the User through GOWEEKENDER will be as per the booking card or as notified to the Customer in writing .

The User must comply with the regulations made by the local authority and the Service Provider Association from time to time.

GOWEEKENDER reserves the right to allow businesses to use customer data to personalize marketing, improve products, enhance customer service, and make better decisions.

The Services are provided on an "as is" and "as available" basis. GOWEEKENDER in its sole right, without prior notice, may also make changes to the features or functionality of the Services it provides from time to time. GOWEEKENDER expressly disclaims all warranties of every kind , whether express or implied , including the reasonable implied warranty of merchantability. No oral or written advice or information obtained by User from GOWEEKENDER or through the Select Services shall create any warranty not expressly stated herein or in the Services' Terms and Conditions .

• •The User also authorizes GOWEEKENDER representatives to contact him/her by phone , text message and email. GOWEEKENDER will use the User's mobile number and contact details to transmit booking confirmations , itinerary information , cancellations , payment confirmations , refund status , rescheduling or any other information related to the User's booking or transaction through SMS, internet-based messaging applications such as WhatsApp , phone , email or any other alternative communication medium provided by the User at the time of booking .
• •GOWEEKENDER may contact the User through the above mentioned means for any pending or failed bookings , to assist the User in understanding their preferences for completing the booking .
• •The User unconditionally consents to receiving communications from GOWEEKENDER via SMS, internet-based messaging applications such as WhatsApp , phone , email or any other means.
• •GOWEEKENDER reserves the right , at its sole discretion , to refuse to accept any booking without assigning any reason thereof .
• •In addition to other remedies and means available to GOWEEKENDER under this User Agreement or applicable law , GOWEEKENDER may limit a User's activity , warn other Users of such User's actions , immediately suspend or terminate a User's registration , or deny the User access to the Website if : The User is in violation of this User Agreement ; or GOWEEKENDER is unable to verify or authenticate any information provided by the User ; or GOWEEKENDER believes that the User's actions may violate the rights of any third party or any applicable law or create liability for the User , other Users, or GOWEEKENDER itself .
• •Once a User has been suspended or deregistered , they shall not register under any other identity , attempt to do so , or use the Website in any way until reinstated as a User by GOWEEKENDER . GOWEEKENDER may reinstate a suspended User at any time in its sole discretion.
• •If a User breaches this User Agreement , GOWEEKENDER shall have the right to recover any outstanding amounts payable to GOWEEKENDER from the User and to take such necessary and appropriate action as may be necessary. have the right to take legal action .
• •The User shall not write or send any material to GOWEEKENDER , or communicate with GOWEEKENDER using language or material that is abusive , threatening , offensive , defamatory , coercive , obscene , belligerent , violent , sexually explicit , illegal or otherwise objectionable ; is contrary to any applicable law ; infringes the intellectual property rights of a third party ; is spam ; or violates any part of the Terms and Conditions of Use . If the User violates any of the above conditions , GOWEEKENDER is free to take appropriate legal action against that User .
• •The User undertakes under this User Agreement to always provide accurate and valid information , and not to misrepresent any facts. Any default by the User may result in GOWEEKENDER denying the User access to its services.
• •If GOWEEKENDER , at any time during or after receiving a request for services from a User, believes or becomes aware that the request is unauthorized , or that any information provided by the User or any Traveler is incorrect or has misrepresented any material fact , GOWEEKENDER reserves the right to take appropriate legal action against the User , including cancellation of the booking without prior notice. In such circumstances , GOWEEKENDER shall not be liable for any loss or damage to the User or any other person involved in the booking as a result of such cancellation of the booking or services.
• •If any judicial , quasi-judicial , investigative agency or government authority requests GOWEEKENDER to cancel any booking , GOWEEKENDER will cancel the booking without contacting the User concerned The User shall not hold GOWEEKENDER liable for any loss or damage arising from measures taken by GOWEEKENDER to protect its interests and those of its genuine customers . This shall include the rejection or cancellation of any booking by GOWEEKENDER due to suspected fraud.

• •GOWEEKENDER employees or authorized representatives will never contact a user for their credit or debit card number , expiration date , CVV , net banking login , password , OTP, etc., nor will they ever request a transfer of funds to any individual or personal bank account. Additionally , they will never ask a user to install any third-party applications that enable them to view the user's mobile or computer screen.
• •Complying with any of these requests could leave you vulnerable to fraud , and potentially result in the loss of valuable money or information.
• •For any issues arising after the reservation is confirmed , the User will contact the Activity Provider directly.
• •The User must ensure that he/she is eligible to avail the Activity including but not limited to age limit , weight limit , health condition etc. The User Understands that if he/she is found unsuitable or ineligible for the activity, the activity provider may disqualify him/her from availing the said activity.

• •We only accept customer reviews , likes , comments from customers who have used our service.
• •We take reasonable measures to detect fake reviews. If we have reason to believe a review is fake , we reserve the right to remove that review and investigate it.
• •We make no representations or warranties regarding the accuracy , authenticity, or truthfulness of any reviews , likes , or comments . Anyone relying on such reviews does so at their own risk .

Adventure Activities Includes day tours and sightseeing , spa and wellness , adventure sports activities , cruises , theme/amusement parks , buffets and meals or any other service/product booked on the website. The provider of the Activity will be called the ' Activity Provider ' and will be solely responsible for the product/service booked by the User.

• •The role of the GoWeekender is determined by the User from the Activity Provider. The activity is limited to facilitating purchases. The contract for providing the service will always be between the User and the Activity Provider.
• •GOWEEKENDER will not provide pickup and drop facility for any activity unless it is expressly stated in the booking confirmation .
• •GOWEEKENDER will not be liable for: Any damage or loss , injury , accident , death , malfunction , irregularity , delay/change in time , cancellation without reason , incorrect information , deficiency in service/product , or activity provider cancellation due to reasons beyond the control of the User's health and safety , any ancillary or follow-up services the user purchases directly from the activity provider , any incorrect information provided by the activity provider.
• •GOWEEKENDER 's maximum liability will be limited to the refund of the booking amount received for booking the activity.

GOWEEKENDER Users understand that GOWEEKENDER acts solely as an aggregator and that GOWEEKENDER shall have no liability to Users for any loss or damage incurred by Users during their travel. In the unlikely event of any unforeseen circumstances , GOWEEKENDER 's liability shall be limited to the User 's booking amount .

• •Through GOWEEKENDER , users can search for other users near their residence and invite them for group trips by connecting through chat. Users ' use of the platform for social connections will be based on their social media experience. It's worth noting that GOWEEKENDER has no control or responsibility whatsoever over a user 's social networking.
• •While using the GOWEEKENDER social media platform, users cannot access information about other nearby users ' addresses, habits, or search history; this information is kept completely encrypted. Information about addresses, habits, and search history can only be obtained through private chats on the app.
• •User social media account information may be disclosed to a government investigative agency if requested .
• •GOWEEKENDER assumes no liability to users for any harm or damage caused by the content posted by users on the platform.
• •GOWEEKENDER is not liable for any false information provided by any registered member. Users are expected to verify identification documents themselves.

The User agrees that GOWEEKENDER never recommends any travel to its Users. The risk of booking any trip is entirely at the user's discretion. In relation to his booking , the User understands that GOWEEKENDER is only providing a technology platform for booking products and services , and the actual responsibility lies with the respective service provider and not with GOWEEKENDER. That is , this service contract is concluded between the user and the service provider.

In case of any dispute , the jurisdiction of the court will be of Patna District Court and Patna Consumer Forum only.
